SEABROOK EXCLUSIVES RENTAL AGREEMENT

PREPAYMENT - 33% of the total invoice amount applies initially. The initial payment is due upon booking and must be made by credit card. The remaining balance is due 30 days prior to arrival on all reservations. Monies will be placed in an interest-bearing account. South Carolina Real Estate Law specifies such interest shall accrue and the signature below releases all interest to Seabrook Exclusives, on this account.

ACCIDENTAL DAMAGE FEE has been included in the reservation and is intended to cover unintentional damages to the property and is non-refundable. This is in lieu of a security deposit. If any damage should occur during the stay, guests must call the office to report the damage to management when it occurs and prior to departure. This fee will cover up to $1500 on a villa, cottage, or townhome and up to $3000 on homes. If, for any reason, the damage exceeds $1500 or $3000, guests will still be responsible for any costs exceeding these amounts.

The ACCIDENTAL DAMAGE FEE does not cover damages to linens.

NON-REFUNDABLE CANCELLATION POLICY: The non-refundable cancellation policy exclusively pertains to reservations booked within 30 days of the intended arrival date. Should a cancellation or no-show occur for reservations falling within this 30-day window, the guest will not be eligible for any reimbursement and will forfeit all monies paid.

CANCELLATION POLICY FOR HOMES

This cancellation policy is applicable to reservations with an arrival date that is 31 days or more from the time of booking.

Cancellations made within 48 hours from the time booked are eligible for cancellation without penalty. After 48 hours the following cancellation policies are in effect:

Cancellations made more than 60 days prior to scheduled arrival date are eligible for a full refund of rent/deposits made. All administrative fees including tax are non-refundable.

Cancellation 60 to 30 days prior to scheduled arrival will result in the forfeit of rental deposit. All administrative fees including tax are non-refundable.

Cancellation within 30 days of arrival date will result in a full forfeiture of all fees and rent with this exception: if the inventory is successfully re-rented, guests will be eligible for a full refund of rent minus any discounting from advertised rack rate necessary to re-rent. In no circumstance will the rent refund be greater than the original amount paid. All administrative fees including tax are non-refundable.

Property changes or changing the length of stay will not result in any refund of rent. This includes but is not limited to early departures.

CANCELLATION POLICY FOR VILLAS AND COTTAGES

This cancellation policy is applicable to reservations with an arrival date that is 31 days or more from the time of booking.

Cancellations made within 48 hours from the time booked are eligible for cancellation without penalty. After 48 hours the following cancellation policies are in effect:

Cancellations made more than 30 days prior to scheduled arrival are eligible for a full refund of rent/deposits made. All administrative fees including tax are non-refundable.

Cancellation within 30 days of arrival date will result in a full forfeiture of all fees and rent with this exception: if the inventory is successfully re-rented, guests will be eligible for a full refund of rent minus any discounting from advertised rack rate necessary to re-rent. In no circumstance will the rent refund be greater than the original amount paid. All administrative fees including tax are non-refundable.

Property changes or changing the length of stay will not result in any refund of rent. This includes but is not limited to early departures.

CANCELLATION POLICY FOR MONTHLY RENTALS (28 nights or more)

This cancellation policy is applicable to reservations with an arrival date that is 31 days or more from the time of booking.

Cancellations made within 48 hours from the time booked are eligible for cancellation without penalty. After 48 hours the following cancellation policies are in effect:

Cancellation 30 days or more prior to scheduled arrival will result in the forfeit of rental deposit. All administrative fees including tax are non-refundable.

Cancellation within 30 days of arrival date will result in a full forfeiture of all fees and rent with this exception: if the inventory is successfully re-rented, guests will be eligible for a full refund of rent minus any discounting from advertised rack rate necessary to re-rent. TRAVEL INSURANCE - Travel insurance is offered as an option to protect you in the event of unforeseen circumstances requiring cancellation or interruption of your trip. The cost of this coverage is 7.75% of base rental rate, tax, and non-refundable fees. It is non-refundable 14 days after purchase. For complete information on the insurance coverage, please visit the RedSky Travel Insurance website at https://www.trippreserver.com/. Travel Insurance is an optional fee.

ADMINISTRATIVE FEES - All reservations are subject to a non-refundable 5.2% reservation fee plus tax.

EXTREME WEATHER - No refunds will be issued for adverse weather including hurricanes and hurricane evacuation. If a mandatory evacuation is ordered, coverage may be available to travel insurance policy holders. This coverage is afforded per the policy in effect and its conditions.

ARRIVAL - Check-in time begins at 4:00 PM. The 4:00 PM check-in time is not guaranteed. Some homes have a modified check-in time of 5:00 PM. Please refer to the unit description for details. No rental rate adjustments will be made due to the property not being ready by 4:00 PM. Arrival instructions will be provided upon receipt of final payment and signed Rental Agreement document.

DEPARTURE - Check out time is 10:00 AM. Some homes have a modified check-out time of 9:00 AM. Please refer to the unit description for details. Any late check outs not approved by our office are subject to an additional charge at the regular nightly rate. All homes and villas are cleaned and inspected upon your arrival/departure. Your credit card will be charged at a rate not less than $150.00 per hour for unauthorized occupancy. Any requests for early occupancy or late departure must be approved by Seabrook Exclusives property management in advance of your arrival date or 3 days prior to the scheduled departure date.

HOME AND VILLA EQUIPMENT

  • All properties are equipped for basic vacation needs. ALL accommodations are privately owned. Properties are furnished and equipped by the Owner. Neither Seabrook Exclusives nor the Owner will be responsible for providing additional furnishings or equipment. Certain areas in each property are kept locked for the Owner’s use and are NOT available to guests. Guest is responsible for the key return. There will be a minimum $75 charge billed to your credit card on file for each lost key.
  • Linens are provided for the maximum number of guests stated for each home and villa.
  • Kitchen utensils and a starter set of toiletries are supplied.
  • Beach chairs and beach towels are not provided. Do not use home or villa linens as beach blankets.
  • If additional cleaning of the home or villa, or linens and/or carpet are found to be excessively dirty, the reservation will be charged an additional fee.
  • Vehicle Passes are limited to a specific number, based upon available parking spaces at each property.
  • Wi-Fi is provided. Changing the password on the Wi-Fi will incur a $250 charge to the credit card on file. Internet service is provided as a guest convenience but is not an explicit amenity of the property. The service and equipment for the internet is provided by a third-party vendor. Seabrook Exclusives cannot ensure your equipment is compatible and properly configured. Seabrook Exclusives has no control over the service provided by these outside vendors. No refunds will be issued due to internet connectivity problems.
  • Not all properties include landline telephones.
  • At the end of your stay, it is expected that guests will wash all dishes and return to their proper location; empty the refrigerator; properly bag and remove all trash to proper exterior receptacles; vacuum excess sand and pet hair (if applicable). Additional charges to your credit card will be made if check-out procedures are not adhered to by guests prior to check-out.
  • Seabrook Exclusives is not liable for articles lost or left upon departure.

OCCUPANCY - The number of guests occupying the property must not exceed the maximum occupancy allowed and must be accurately reflected in your reservation confirmation. Seabrook Exclusives reserves the right to terminate this agreement and ask guests to vacate the premises without reimbursement if more than the stated number of guests allowed occupy the dwelling.

SOCIAL FUNCTIONS - Parties or social functions (i.e., reunions, receptions, Weddings, etc.) with guests in attendance in numbers which exceed the stated maximum number of persons per rental are specifically prohibited in any rental property. Guests found in violation of this agreement will forfeit any security deposit and will be responsible for any additional restoration charges.

RESTRICTIONS - Motor homes, motorcycles, trailers and/or boats are not allowed. LSV's/Golf Carts are not permitted in Pelican Watch Villas and Bohicket Marina Villas. Guests are not permitted to re-arrange furnishings in any way.

NO SMOKING - ALL PROPERTIES ARE STRICTLY NON-SMOKING! A $500 fee WILL apply for violation of this policy. Smoking is not permitted inside any property offered by Seabrook Exclusives. If you or any of your guests are found to be smoking inside a unit you will be asked to vacate the property immediately, forfeiting any remaining rental nights. Your credit card will be charged a minimum of $500 if the property smells like smoke. Additional charges may apply if further action is necessary to mitigate damage from smoking.

Parking is only permitted in designated areas. Vehicles must be parked completely on concrete or asphalt. Guests credit card on file will be billed a minimum of $100 per vehicle infraction. If damage occurs to the property due to parking illegally your credit card on file will be billed for repairs. NO parking is permitted on grass, yard, pine straw, or other natural vegetation.

AGE RESTRICTIONS - Seabrook Exclusives rents to adults over the age of 25 only. If it is determined through verification of proper identification that a responsible party of at least 25 years of age is not in residence, the entire group will be escorted from the property with the assistance of local authorities if needed. Re-entry to the property will not be allowed and there will be no monetary refund.

PETS - Without exception, no pets are allowed in any property unless specifically designated as pet-friendly and a non-refundable fee is paid. We accept dogs only. ALL dogs must be explicitly approved by Seabrook Exclusives prior to arrival. No exceptions! MOST rental units only permit one dog. Certain breed restrictions apply based on the individual unit rules. NEITHER Seabrook Exclusives NOR THE PROPERTY OWNER WILL BE RESPONSIBLE FOR ANY PROBLEMS, DAMAGE, OR INJURY CAUSED BY ANY PET. PETS ARE NOT PERMITTED ON THE FURNITURE AT ANY TIME. ADDITIONAL CLEANING AND DAMAGE FEES WILL APPLY. A $500 fine in addition to the pet fee WILL apply if any pet is found in a non-pet friendly property. In addition, If found in violation of this regulation you will be asked to leave, forfeiting any remaining rental nights. If you are unsure of the status of the property, PLEASE contact Seabrook Exclusives before confirming this contract. No exceptions, remedies or refunds will be offered for guests found to have a pet in a non-pet friendly property.

CANCELLATION CLAUSE - Seabrook Exclusives may, at its option, cancel or suspend, in whole or in part, this Rental Agreement for anyone, with or without cause, at its discretion. Including, but not limited to, the following situations a) the failure, refusal, or inability of the guest to pay in accordance with this Rental Agreement for any reason; b) guest breaches any of the terms herein the Rental Agreement; c) It is learned that the Property was reserved at an incorrect amount within 10 days of the signed rental agreement; d) Property becomes unavailable for guest use through the sale of the premises or other circumstances beyond the reasonable control of the rental agent.

PROPERTY AVAILABILITY - Should a property become unavailable for guest use through the sale of the premises or other circumstances beyond the reasonable control of the rental agent, the agent may substitute with the best available, comparable accommodations for the same period.

MAINTENANCE - Seabrook Exclusives makes every attempt to make sure the home or villa you have rented is in good working order when you arrive. If you do encounter a maintenance problem in the home or villa, it will be handled in a timely and professional manner. Seabrook. is not responsible for resort amenities, such as scheduled or unscheduled untimely construction, pool, and spa closures, etc. Rental rates will not be adjusted due to any malfunction of equipment, including appliances or air conditioning/heat breakdown, and/or construction occurring at an adjacent property or another unnamed area. Seabrook Exclusives or its Agent may re-enter the rental property at a reasonable time for the purpose of making repairs or for routine maintenance.

Although all properties are maintained on a regular basis, at times maintenance repairs may be required. Seabrook Exclusives reserves the right to perform maintenance or have an outside vendor perform maintenance at any time during the stay. If the property is pet-friendly, dogs must be secured while the guest is away. Rental fees will not be refunded or reduced due to maintenance at the property rented or at neighboring properties due to construction.

FINAL PAYMENT ELECTION - The final payment will be processed 30 days prior to scheduled arrival on your card on file for all reservations. You understand and agree there will be a $15.00 service fee for the use of multiple credit cards. If paying by check: Final payment will be sent to Seabrook Exclusives to arrive no later than 30 days prior to scheduled check- in. Send checks to 4343 Betsy Kerrison Pkwy, Johns Island, SC 29455 If the final payment is not received 30 days prior to scheduled check-in the credit card on file will be charged. In no case will a personal check be accepted less than 30 days prior to arrival.

ADDITIONAL FEES - Seabrook Exclusives collects and remits fees for certain third-party entities such as local taxing authorities, Homeowners Associations (HOA), and Property Owners Associations (POA). These entities control fees such as (but not limited to) gate/car passes and may, at their discretion, add, change, or increase fees at any time. Said changes are beyond the control of Seabrook Exclusives and are the financial responsibility of the guest. Seabrook Exclusives will notify guests of any changes in fees as soon as possible and reserves the right to adjust the balance of the reservation to reflect said changes.

LIABILITY

As a guest of the owner and Seabrook Exclusives, you understand that while using a private or community pool (or spa), you and any guests are swimming at your own risk. In consideration and on behalf of your guests, Seabrook Exclusives and the pool owner are released from any liability or claims arising from injury while using the pool. Seabrook is home to many forms of wildlife including Alligators. Seabrook Exclusives is not responsible for any injury caused by guest’s negligence that may cause injury by any wildlife animal including Alligators. If renting a property with decks or dock access, Guest agrees to release and indemnify the Owner and Agent from and against liability for injury to the Guest or any member of Guest’s household or guests of Guest to the Property resulting from use of the decks or docks.

IN NO EVENT WILL SEABROOK EXCLUSIVES’ LIABILITY FOR ANY ACT OR OMISSION UNDER OR IN CONNECTION WITH THIS RENTAL AGREEMENT EXCEED THE COMPENSATION RECEIVED BY SEABROOK EXCLUSIVES FROM PROPERTY OWNER UNDER OR AS A RESULT OF THIS RENTAL AGREEMENT. SEABROOK EXCLUSIVES WILL NOT UNDER ANY CIRCUMSTANCES BE RESPONSIBLE FOR ANY INDIRECT OR CONSEQUENTIAL DAMAGES SUCH AS LOST TRAVEL EXPENSES. SEABROOK EXCLUSIVES DISCLAIMS ALL LIABILITY FOR ANY DAMAGE TO OR THEFT OF ANY PERSONAL PROPERTY THAT GUEST BRINGS TO THE PREMISES. TO THE FULLEST EXTENT PERMITTED UNDER LAW, SEABROOK EXCLUSIVES WILL NOT BE LIABLE FOR ANY PERSONAL INJURY OR DEATH OCCURRING IN OR ABOUT THE PREMISES UNLESS CAUSED BY SEABROOK EXCLUSIVES’ RECKLESS OR WANTON AND WILLFUL ACT OR OMISSION.

I UNDERSTAND AND AGREE TO THE ABOVE TERMS AND CONDITIONS. Guest (to include guest invitees) further agrees to indemnify and save Agent, its employees and property owners, free and harmless from any claim or liability for any loss or damage whatsoever including but not limited to personal injury or damage/loss of property, arising from, related to, or in connection with the rental of the above premises or any rental equipment ordered through Seabrook Exclusives. Seabrook Exclusives reserves the right to refund or refuse rental to anyone.
